Terms and Conditions for Tutum Bird and Pest Management Ltd

These Terms and Conditions ("Agreement") govern the provision of pest management services ("Services") by Tutum Bird and Pest Management Ltd ("Company", "we", "us", "our") to the Client ("you", "your").
By engaging us for any Services, you agree to the following terms:
1. Scope of Services
- The Company agrees to provide pest control and management services as detailed in the service agreement or quotation issued to you. Services may include inspection, treatment, and follow-up visits where necessary.
- The type of pests to be treated, methods of treatment, and frequency of service will be agreed upon prior to the commencement of work.
- All services will be carried out with due care and diligence in accordance with industry standards and regulations.
2. Client Obligations
- Access: You agree to provide us with access to the property on agreed dates and times to carry out inspections and treatments. Failure to do so may result in additional charges or rescheduling fees.
- Preparation: You are responsible for preparing the property as advised by us (e.g., clearing certain areas, ensuring pets are secured). Failure to comply may result in incomplete treatment or rescheduling.
- Post-Treatment: After treatment, you agree to follow any instructions provided by us, such as vacating the premises, avoiding treated areas, or maintaining hygiene standards.
3. Health and Safety
- We will take all reasonable steps to ensure that the services provided are safe for people, pets, and the environment. However, you must inform us of any specific health concerns, allergies, or sensitivities that may be relevant to the treatments used.
- We shall not be liable for any adverse effects resulting from your failure to follow safety instructions provided by our technicians.
4. Service Guarantee
- We strive to achieve effective pest control through our services. In cases where additional treatments are required, the Company will provide follow-up visits as per the terms specified in your service agreement.
- If the issue persists beyond a reasonable period, and the client has adhered to all preparation and post-treatment instructions, we will reassess and may conduct further treatments without additional charges, subject to our discretion.
5. Pricing and Payment Terms
- The price for the Services will be as set out in our quotation or as otherwise agreed in writing. All prices are inclusive of VAT unless stated otherwise.
- Payment is due upon completion of the Services unless otherwise agreed. For ongoing contracts, payment must be made in accordance with the agreed schedule (e.g., monthly, quarterly).
6. Cancellation and Rescheduling
- You may cancel or reschedule a service by providing at least 48 hours' notice. Failure to do so may result in a cancellation fee.
- We reserve the right to cancel or reschedule services due to unforeseen circumstances, such as extreme weather conditions or technician illness. In such cases, we will contact you to arrange an alternative date.
7. Liability
- We will not be liable for any loss or damage unless caused by our negligence or breach of this Agreement. Our liability shall be limited to the cost of the Services provided.
- We are not responsible for any pre-existing damage to your property or contents, or for pests' return due to failure to follow our aftercare recommendations.
- While we take precautions to prevent recurrence, we cannot guarantee that pests will not return, particularly where conditions conducive to pest infestation (e.g., food sources, entry points) remain unresolved.
8. Force Majeure
- The Company shall not be liable for any failure to perform our obligations where such failure is due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, or severe weather.
9. Confidentiality
- Any personal information collected by us will be treated in accordance with our Privacy Policy and the applicable data protection laws. We will not share your details with third parties without your prior consent, except as required by law.
10. Termination
- Either party may terminate this Agreement by giving 7 days' written notice to the other. Termination may occur immediately if there is a material breach of this Agreement.
- Upon termination, any outstanding payments for services already rendered will be due immediately.
11. Amendments
- We reserve the right to amend these terms and conditions from time to time. Any amendments will be effective upon posting on our website or notifying you directly.
12. Governing Law
- This Agreement is governed by the laws of England and Wales, and any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Complaints Procedure
- If you are dissatisfied with any aspect of our service, please contact us directly in writing. We will endeavour to resolve any issues promptly in line with our complaints policy.
14. Entire Agreement
- These terms and conditions constitute the entire agreement between the parties and supersede any prior agreements, understandings, or discussions, whether oral or written.
